Penalties should be considered reasonable. We lawyers love the term reasonable. It can mean anything depending on what your point of view is. Bernie Madoff might think it is perfectly reasonable to charge a $29 penalty for a $15 delay of payment. It would likely be less reasonable for the person whose payment was delayed by a day. Under the new regulation, the punishment would have to fit the crime. Card issuers cannot impose penalties exceeding the amount of the infraction. In the example above, the fee cannot exceed $15.00.
I don’t mind being regulated. I’ve lived with the absurdity and regulation of rent regulation since I was a New York City building manager and property owner. I’ve survived and prospered despite it. Smart regulation is what I want. Any regulation or law that is too complicated to understand becomes meaningless. Enforcement is only possible if there is simplicity. It is not productive for an economy to have lobbyists and congressional staffers writing complicated laws and regulations. That only ends up employing people in those nonproductive occupations. It does not add any new products to the American economic system.
I hope it turns out to be a case of corruption – because I would hate to think that it was mere stupidity on the part of policy makers in the federal government.
